OVERVIEW

SculptureMade operates this store and website, including related content, tools, products, and services (the “Services”). This Privacy Policy explains how personal information is collected, used, and disclosed when you browse, request a quotation, submit project materials, apply for professional access, purchase a product, or communicate with us.

Our store is hosted by Shopify. This policy addresses SculptureMade’s handling of information and explains Shopify’s role below. If our Terms of Service and this policy differ on the treatment of personal information, this policy governs that issue, subject to applicable law. This notice does not replace a separate consent request where consent is required.

PERSONAL INFORMATION WE COLLECT OR PROCESS

Personal information means information that identifies you or can reasonably be linked to you. It does not include information that has been lawfully anonymized or de-identified so that it cannot reasonably identify you. The information involved depends on your interactions, the features you use, and applicable law.

Contact information. Names, email addresses, telephone numbers, billing and delivery addresses, and information about an authorized recipient or project contact that you provide.

Payment and transaction information. Order details, purchases, returns, cancellations, payment method, payment status, billing information, and transaction references. Payment providers process the card or financial account details needed for the chosen payment method. We receive the transaction information and any limited payment identifiers made available to us for billing, verification, and support. Do not send complete card numbers, security codes, bank login passwords, or one-time authentication codes to us by email or text message.

Account information. Account identifiers, authentication information handled through the applicable account system, preferences, and settings when you use an account feature.

Communications and project information. Messages, support requests, reviews, quotations, design approvals, photographs, drawings, dimensions, inscriptions, and other information you choose to submit. Professional applications may include business contact details, your role, and project requirements. Project files can contain personal information about you, a client, or another person.

Device and usage information. IP address, browser and device information, network information, identifiers, pages viewed, navigation activity, product interactions, and the timing of visits. Depending on the features used, this can include cart, wishlist, and purchase activity collected through cookies and similar technologies.

Preferences and inferences. Preferences you provide and interests inferred from relevant interactions, such as products viewed or purchased, for the purposes described in this policy and subject to applicable privacy choices.

PERSONAL INFORMATION SOURCES

We receive information directly from you when you browse, complete a form, create or use an account, communicate with us, or place an order. An authorized representative may also provide information for a client project or delivery.

We collect device and usage information automatically through the Services. We may also receive information from Shopify, payment and fulfillment providers, other service providers working on our behalf, and business or advertising partners in connection with the activities described in this policy.

HOW WE USE PERSONAL INFORMATION

Providing and supporting the Services. We use relevant information to answer inquiries, prepare quotations, review professional applications, develop and confirm specifications, process payments, manufacture and deliver orders, maintain accounts, and handle changes, returns, refunds, and customer support.

Improving and personalizing the experience. We use relevant transaction, preference, and usage information to understand how the Services are used, remember selections, improve site performance, and provide product recommendations.

Marketing and advertising. We may use contact details and relevant interactions to send permitted promotional communications and, with advertising partners, measure or display advertisements on our website and other services. These activities are subject to consent requirements and opt-out rights where applicable. Providing information needed to fulfill an order does not automatically provide consent to every optional marketing use.

Security and legal purposes. We use information to authenticate users, verify transactions, prevent fraud and unauthorized activity, maintain records, comply with legal obligations and valid requests, resolve disputes, and protect the Services and the rights of customers and others.

Where applicable law requires a lawful basis, order and project processing may be necessary to perform a contract or take steps you request before a contract. Security, service improvement, and other permitted operational uses may rely on legitimate interests, balanced against your rights. Legal recordkeeping may rely on legal obligations. Activities requiring consent, including certain marketing and tracking, rely on that consent. Where processing depends on consent, you may withdraw it without affecting processing that was lawful before withdrawal.

CUSTOM SCULPTURE AND PROFESSIONAL PROJECT MATERIALS

Photographs, drawings, private property images, portraits, inscriptions, and other project materials are used as reasonably necessary to assess your request, prepare a quotation, develop the agreed design, manufacture and deliver the order, and provide support. Relevant information may be shared with the designers, fabricators, and service providers involved in that work.

Submitting private project materials does not automatically authorize us to publish them, identify you or your client, or use private photographs or plans in advertising. Promotional use requires separate permission where it has not already been clearly authorized. Any separately agreed confidentiality terms also apply, as described in our Terms of Service.

Provide only information needed for the project and ensure that you have authority to provide information about another person. Remove unrelated personal details from plans or photographs where practical. Contact us before sending especially sensitive information so that an appropriate submission method and any required consent can be addressed.

COOKIES AND SIMILAR TECHNOLOGIES

We and our providers, including Shopify, use cookies and similar technologies for functions such as maintaining sessions and shopping carts, remembering preferences, understanding website use, and advertising activities described above.

Where applicable law requires consent for non-essential tracking, we will obtain that consent before the relevant use. Use the cookie controls made available for your region to manage or withdraw consent. Necessary functions, such as maintaining security and processing a requested checkout, may operate without optional advertising consent.

Browser settings can also limit cookies, although blocking necessary cookies may affect site functionality. Cookie settings, promotional-email preferences, and opt-outs from sale, sharing, or targeted advertising address different activities. See Your Privacy Choices and the rights section below for additional controls.

HOW WE DISCLOSE PERSONAL INFORMATION

Service providers. We disclose information needed for the work performed by Shopify and providers supporting hosting, storage, communications, product configuration, payment processing, customer support, fabrication, shipping, and other order services. For example, a carrier needs delivery and contact information, while a fabricator may need the relevant approved design.

Business and advertising partners. In connection with the marketing activities described above, identifiers, device and usage information, relevant shopping activity, and related preferences may be disclosed to advertising or business partners. Some disclosures may be considered a “sale,” “sharing,” or “targeted advertising” under applicable privacy laws, even when no money is exchanged for the information. The opt-out options below apply where available under those laws.

At your direction or with permission. We may disclose information to a person or service you ask us to involve, or through an optional integration you choose to use. Publicly submitted reviews and other content intended for public display can be seen by others. Private project materials remain subject to the separate protections described above.

Business transfers and legal purposes. Information may be disclosed within an applicable corporate relationship, in connection with a merger or other business transfer, to meet legal obligations or valid legal process, or to address fraud, disputes, and threats to rights or safety. Such disclosures remain subject to applicable privacy protections.

RELATIONSHIP WITH SHOPIFY

Shopify hosts our store and processes information about visits and purchases to provide and improve its platform. Information submitted to the Services is shared with Shopify and relevant service providers, which may be located in countries other than your own.

In providing its platform and any enhanced services used by our store, including Shopify Network Intelligence, Shopify may process information from interactions with our store together with information from interactions with other merchants and Shopify. These services can support personalization, business improvement, and advertising, subject to applicable consent and opt-out requirements.

For processing where Shopify acts independently, Shopify is responsible for the applicable privacy obligations and rights requests. Read the Shopify Consumer Privacy Policy and use the Shopify Privacy Portal to learn about Shopify’s processing and exercise relevant rights. You may contact us about information handled for SculptureMade.

THIRD-PARTY WEBSITES AND PUBLIC CONTENT

The Services may link to independent websites or offer optional third-party features. Review the relevant provider’s privacy information before submitting information to it. A link does not, by itself, mean that we control or endorse that provider’s practices.

Information you knowingly publish in a review or other public area may be accessible to other users. This does not turn private communications or project submissions into public content. This section does not remove our responsibilities for information that we collect or disclose ourselves.

CHILDREN’S DATA

Our store and purchasing services are intended for adults, not for children to use independently. We do not knowingly collect personal information directly from children using the Services on their own. If you believe a child has provided information without appropriate authorization, contact us so that we can review and address it as required by law.

An adult may submit a family photograph or other material for an authorized custom project. That material is subject to the project-use restrictions above and any required permission. We do not knowingly sell or share personal information of individuals under 16 for cross-context behavioral advertising.

SECURITY AND RETENTION

We use reasonable safeguards intended to protect personal information, but no system or transmission method can guarantee complete security. Keep account credentials private and use the appropriate checkout or submission method for sensitive information. We will not ask you to email complete payment credentials or account passwords.

We retain information for the periods reasonably needed for the purposes described here, taking account of the information’s nature, the relationship or project, applicable legal obligations, disputes, and your rights. Different categories may have different retention periods.

Order, payment, and communication records may be needed for fulfillment, refunds, accounting, and claims. Project records may be needed to document approved specifications and provide support. Account information is retained as needed to maintain the account and associated obligations. Marketing preferences and limited suppression records may be retained to respect an opt-out. Device and usage records are retained according to their operational, security, and analytics purposes.

When information is no longer needed and no lawful retention basis remains, we delete or de-identify it as appropriate. A deletion request may be subject to exceptions for records that the law permits or requires us to retain; we will explain an applicable exception when responding.

YOUR RIGHTS AND CHOICES

Depending on your location and applicable law, you may have rights to know about or access personal information, obtain a portable copy, correct inaccuracies, request deletion, restrict or object to certain processing, withdraw consent, or limit certain uses of sensitive personal information. These rights are subject to applicable conditions and exceptions. We will not discriminate against you for exercising a protected right.

Sale, Sharing, and Targeted Advertising

Use Your Privacy Choices to exercise applicable opt-out rights. You may also contact us using the details below. If a control is unavailable or does not appear to work, tell us so that we can assist; a technical problem does not remove an applicable right.

We honor Global Privacy Control (GPC) and other opt-out preference signals where required by applicable law. A recognized GPC signal applies to the browser or device transmitting it; we also apply it to associated account information where the association can be made and applicable requirements provide for it. You do not need to create an account to exercise a device-based opt-out.

A browser-based choice may need to be repeated if you use another browser or device or clear the cookies that store the preference. We do not treat other general “Do Not Track” browser settings as a separate opt-out mechanism unless required by law. An advertising opt-out does not necessarily stop all advertising; it limits the relevant use of information for the activities covered by the choice.

Marketing Communications

Use the unsubscribe option in a promotional email or contact us to stop those messages. Follow the opt-out instructions supplied with any other optional marketing channel you use. Necessary order, delivery, account, and service communications may continue after you opt out of promotional messages.

Submitting a Privacy Request

Contact support@sculpturemade.com or call +1 (213) 343-0224 and explain the right you wish to exercise. You do not need to create a new account to submit a request.

For access, correction, deletion, or another request that requires verification, we may seek reasonable information to verify identity and locate the relevant records. Do not send complete card numbers, account passwords, or other unnecessary sensitive information. Verification requirements will be proportionate to the request and applicable law; a device-based advertising opt-out is not subject to the same identity-verification process as a request to obtain private order records.

An authorized agent may act on your behalf where permitted by law. We may require evidence of authority and any identity confirmation permitted for the particular request. We will respond within the applicable legal period and explain any permitted extension or reason for declining a request. Requests concerning Shopify’s independent processing can also be made through the Shopify Privacy Portal.

COMPLAINTS AND APPEALS

Contact us if you have concerns about how we handle personal information. Where applicable law provides an appeal right, you may appeal a declined request by replying to our decision or contacting us and stating that you wish to appeal. We will review and respond as required.

You may also complain to the competent privacy regulator or supervisory authority. Contacting us first is not required where the law permits you to complain directly to that authority.

INTERNATIONAL TRANSFERS

Personal information may be stored, accessed, or processed outside the country where you live, including by Shopify and the providers involved in our store, customer support, fabrication, or delivery. Privacy laws in those countries may differ from those in your location.

Where applicable law requires safeguards for a transfer, we will use an appropriate lawful mechanism. For transfers from the EEA or the United Kingdom to a country without an applicable adequacy determination, this may include approved standard contractual clauses or the relevant UK transfer mechanism. Contact us for information about applicable safeguards. This section does not authorize a transfer that applicable law prohibits.

CHANGES TO THIS PRIVACY POLICY

We may update this policy to reflect changes in our practices, Services, or legal requirements. We will revise the date above and provide notice of material changes, and obtain any additional consent, where required by law.

A policy update does not itself provide consent to a new use where consent is required. We will not disregard an existing applicable opt-out simply because the wording of this policy changes.
